Terms of Service and EULA

1. Who we are

These Terms govern your use of the Kite Prompter mobile application (the "App") provided by ILIA TSVETKOV, a sole proprietor (Individual Entrepreneur) registered in Georgia, address: Georgia, Tbilisi, Nadzaladevi district, Chargali street N79b, flat N408 ("we", "us", "Developer"). 2. Acceptance

By downloading, accessing, or using the App, you agree to these Terms and our Privacy Policy. These Terms form a legally binding End-User License Agreement (EULA) between you and us. If you do not agree, do not use the App.

3. The Service

Kite Prompter is a professional teleprompter tool offering adaptive scrolling, text formatting, script management, and cloud synchronization across devices.

4. Subscriptions, Trials, and Payments

The App may offer a free trial based on limited playback time or script count. After the trial, continued access to premium features requires a subscription.

• Payments are charged to your Apple ID or Google Play account at confirmation of purchase.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• You can manage and cancel your subscriptions in your App Store or Google Play account settings. Canceling stops future renewals but does not refund the current paid period.

5. User Content and Rights

You retain all intellectual property rights to the text, scripts, and content you input into the App. We claim no ownership over your User Content. You are solely responsible for ensuring that your content does not violate any laws or third-party rights. We store your content solely to provide synchronization services across your devices.

6. Acceptable Use

You agree not to: (i) violate any applicable laws; (ii) reverse-engineer, decompile, or disassemble the App; (iii) attempt to bypass our trial metering or subscription validation systems; (iv) use the App to distribute malware or illegal content.

7. Apple App Store Specific Terms

If you downloaded the App from the Apple App Store, the following applies:

• Acknowledgment: This EULA is concluded between you and us only, not with Apple. We are solely responsible for the App.
• Scope of License: You are granted a non-transferable license to use the App on Apple-branded products you own or control, as permitted by Apple's Usage Rules.
• Maintenance and Support: We are solely responsible for maintenance and support. Apple has no obligation to furnish any support services.
• Warranty: If the App fails to conform to any applicable warranty, you may notify Apple for a refund of the purchase price. Apple has no other warranty obligation.
• Product Claims & IP: We, not Apple, are responsible for addressing any claims relating to the App or intellectual property infringement.
• Third-Party Beneficiary: Apple and its subsidiaries are third-party beneficiaries of this EULA and can enforce it against you.

8. Limitation of Liability

To the maximum extent permitted by law, the App is provided "AS IS" and "AS AVAILABLE". We shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or interrupted performances arising from the use or inability to use the App.

9. Governing Law & Venue

These Terms are governed by the laws of Georgia. Exclusive venue for any disputes: competent courts of Tbilisi, Georgia, unless mandatory consumer protection laws dictate otherwise.
